SECTION 1 – DEFINITIONS
1.1 ‘FindaRoom.london’ is established in Amsterdam under Chamber of Commerce registration number 63905558.
1.2 ‘Service’; FindaRoom.london focuses on bringing together owners of accommodation with potential tenants. This is the ‘service’.
1.3 ‘Tenant’ is a natural person or legal person, looking for living space and who wishes to be aware of the offer on the FindaRoom.london website.
1.4 ‘Landlord’ is a natural person or legal person, looking for a tenant and who adds one or more adverts on the FindaRoom.london website.
1.5 ‘User’; the tenant and/or owner.
1.6 ‘Advert’; the advertisement in which housing is offered by a landlord and which is visible on the is a natural person or legal person website.
1.7 ‘Website’ is the is a natural person or legal person website: www.findaroom.london or subdomains, other extensions of that domain and mobile applications.
1.8 ‘Account’ is the online space a tenant or landlord creates with his email address or Facebook account to use the services of FindaRoom.london.
1.9 ‘Premium account’ is the type of account a tenant uses to access the contact page of the owner of the accommodation. A premium account is a payable account, which can, for a limited period of time, be offered for free by FindaRoom.london for promotional purposes.
1.10 ‘Personal data’; the data that is entered by users on the website during the creation of an account or subscribtion to a newsletter.
1.11 ‘General terms & conditions’ are the conditions as stated in the present document.
SECTION 2 – APPLICABILITY
2.1 The general terms & conditions are applicable to all visitors of the website, that use the services of FindaRoom.london, including tenants and owners. Before a tenant takes a premium account on this website, FindaRoom.london will announce its general terms & conditions.
2.2 If a provision of the general terms & conditions is rendered null and void, the remaining provisions shall remain in force.
2.3 FindaRoom.london has the right to change these terms and conditions without prior notice. Any changes will be immediately applicable, unless otherwise noted. The changes will be announced on the FindaRoom.london website. Tenants and landlords imply to accept the changes to the terms and conditions, if they make use of the FindaRoom.london services, after changes to the terms and conditions have been made.
SECTION 3 – DELIVERY OF SERVICE
3.1 FindaRoom.london focuses on bringing together owners of accommodation with potential tenants. FindaRoom.london only plays a facilitating role. FindaRoom.london is not responsible for the conclusion of an agreement between tenant and landlord and/or the contents of the agreements. FindaRoom.london will not act as a mediator.
3.2 FindaRoom.london does not provide any guarantees on the effectiveness of the service. More specific, FindaRoom.london does not warrant that:
a. the landlord is authorised to provide said living space.
b. landlord and tenant will actually come to an agreement.
c. the actual living space, offered by the landlord, is in accordance with the offered description.
d. the information in the advertisement is correct, up to date, complete and not unlawful.
e. the website will be devoid of any technical errors.
f. the website will be devoid of attempts of cybercrime.
SECTION 4 – USING THE SERVICE
4.1 In order to use the service, the user must log in with his email address or Facebook account and a password.
4.2 User is obliged to block access to his account through the use of said email address and password. The password in particular must be kept secret. FindaRoom.london can assume that all transactions performed from an account are also actually performed by the user who has created the account. The user himself is responsible for any transactions that are performed on his account.
4.3 User will permit all forms of processing of personal data insofar they fall within the scope of the service.
4.4 When the user logs in via his Facebook account, he will thus provide FindaRoom.london access to the user’s email address (linked to his Facebook account). This email address is necessary for the use of the service.
4.5 FindaRoom.london guarantees the user’s privacy. Personal data – either provided directly by the user or obtained through the Facebook login – will never be provided to third parties, unless necessary for the actualisation of the service.
SECTION 5 – USAGE RULES
5.1 It is prohibited to use the service for transactions and/or purposes that are in violation of English law and regulations. This means, among other things, that this service will not be used for spreading defamatory, ignominious or racist information. Also, it is not permitted for users to assume a false identity.
5.2 Additionally, it is prohibited to use this service to:
a. Post, or link to, information that is in violation of copyright.
b. Post, or link to, information with the purpose to advertise for third parties or other commercial goals, not being the renting of the owned accommodation.
c. Post, or link to, pornographic or erotic content.
d. Post, or link to, information with indecent language.
e. Post, or link to, information with any other purpose than the offering of living space.
f. Post, or link to, information for the purpose of violating the privacy of third parties.
g. Post, or link to, personal data.
5.3 It is prohibited to affect the operation of the service in a negative way. This includes the following:
a. Causing errors.
b. Sending unsolicited emails to users.
5.4 It is not permitted to use the obtained personal data of another user for any other purpose than the conclusion of a rental agreement.
5.5 In case FindaRoom.london discovers the violation of these terms by a user, or is informed about such, FindaRoom.london is allowed to end the violation itself. FindaRoom.london is entitled to change or remove information in an advert at its sole discretion.
5.7 If, in the opinion of FindaRoom.london, a user is found to endanger, abuse or damage the service, FindaRoom.london shall be entitled to take all measures deemed reasonably necessary to prevent or divert the danger.
5.8 FindaRoom.london is entitled, in all cases, to report any detected criminal offenses to the proper authorities.
5.9 FindaRoom.london is entitled to provide identifying user data to a third party, if they can provide credible arguments that a user violates his or her rights or these general terms & conditions.
5.10 FindaRoom.london can recover any damages caused by violations of these usage rules to the user. User exonerates FindaRoom.london of all third-party claims regarding information posted by said user.
SECTION 6 – WARRANTIES
6.1 FindaRoom.london strives to make the service available, but does not guarantee uninterrupted availability.
6.2 FindaRoom.london guarantees no result regarding to service. FindaRoom.london is in no way involved in the conclusion of a rental agreement between tenant and landlord.
6.3 FindaRoom.london strives to keep the service free from information as described in section 5, paragraph 2. FindaRoom.london can, in no way, guarantee the competence of the users and the correctness of the information posted by users.
SECTION 7 – LIABILITY
7.1 FindaRoom.london cannot vouch, or is liable, for the correctness of the offered accommodation, descriptions, images, prices and tenant or provider data, either to the tenant or the owner.
7.2 User exempts FindaRoom.london of all claims concerning the data that is stored through the service, in particular with regards to a violation of the privacy rights, within the meaning of the Personal Data Protection Act.
7.3 For the occurrence of any right to compensation, user is required to report any damage to FindaRoom.london, in writing and within a period of thirty days after the discovery of the damage.
7.4 Force majeure exonerates FindaRoom.london from compensation of consequential damage caused to user.
7.5 FindaRoom.london cannot warrant, or is liable for, the conclusion of a rental agreement, to either tenant nor owner.
7.6 If, and to the extent that, an English judicial organisation nevertheless considers that FindaRoom.london is liable for any damage sustained by the tenant or the landlord or a third party and is held to compensate the damage in whole or in part, the amount of the compensation is limited to an amount of £ 250.
SECTION 8 – COMPLAINTS
8.1 User will submit all complaints in writing. To do so, send an email to: firstname.lastname@example.org
SECTION 9 – FINAL PROVISIONS
9.1 If a provision of the general terms & conditions has lost its validity or is declared null and void, the remaining provisions in these general terms & conditions shall remain in force. In this case, parties will establish new provisions for this section, so as to allow, as much as possible, the intention of the original provision.
